New York Heroin Possession Penalties

Depending on these factors, you could be charged with Criminal Possession of a Controlled Substance (CPCS) in the 4th Degree up to CPCS in the First Degree, an A1 felony, carrying numerous years in the state prison system.

Fortunately, if this is your first possession charge and as long as you aren’t accused of possessing much heroin, you may be able to avoid prison time altogether. This is typically done via a plea agreement.

The vast majority of New York heroin possession cases result in a plea agreement. Very few ever go to trial.

A plea agreement is where you plead guilty to at least part of the charges against you in exchange for a lenient sentence or reduced charges. In some arrangements, no jail time is required and you serve probation instead. The details of your plea agreement are worked out between the prosecution and the defense (you and your attorney).
