NY Bail Jumping Laws & Penalties

Bail jumping charges in New York are of increasing seriousness depending on the severity of the charges for which you missed your court date.

Bail Jumping in the First Degree – 215.17

First degree bail jumping is a charge for missing court on the most serious felonies.

In order to prove that an individual is guilty of Bail Jumping in the First Degree, it must be established that the person:

1) is charged with a Class A or Class B Felony,

2) fails to appear in court on a required date, and

3) fails to appear voluntarily within the next 30 days.

1st degree Bail Jumping is a D Non Violent Felony Charge.

Bail Jumping in the Second Degree – 215.56

In order to prove that an individual is guilty of Bail Jumping in the Second Degree, it must be established that the person:

1) is charged with a Felony,

2) fails to appear in court on a required date, and

3) fails to appear voluntarily within the next 30 days.

2nd degree Bail Jumping is an E Felony Charge.

Bail Jumping in the Third Degree – 215.55

In order to prove than an individual is guilty of Bail Jumping in the Second Degree, it must be established that the individual:

1) is charged with any crime,

2) fails to appear in court on a required date, and

3) fails to appear voluntarily within the next 30 days

3rd degree Bail Jumping is an A Misdemeanor Charge.
